California Enterprise Technology Contract

This contract may be used by The State of California state agencies and local government agencies including the California State Universities (CSU) and University of California (UC) systems, K-12 schools and community colleges empowered to expend public funds for the acquisition of products.
WWT is not the manufacturer of the Original Equipment Manufacturer ("OEM") products or the provider of any OEM support or OEM professional services. WWT will pass through any warranty extended to WWT by the OEM. WWT further warrants that the deliverables provided by WWT professional services will be of the kind and quality designated in an applicable Statement of Work and that the WWT professional services will be performed in a professional and workmanlike manner. EXCEPT AS SET FORTH HEREIN OR IN AN APPLICABLE SOW, THE FOREGOING ARE THE SOLE AND EXCLUSIVE WARRANTIES GIVEN BY WWT AND ARE IN LIEU OF AND EXCLUDE ALL OTHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WWT DOES NOT WARRANT THE RESULT OF ANY PROFESSIONAL SERVICE OR THAT THE PROFESSIONAL SERVICE WILL MEET CUSTOMER'S REQUIREMENTS OR THAT ANY DELIVERABLE BE ERROR-FREE.
