California Enterprise Technology Contract

This is a mandatory contract to provide Enterprise Technology equipment to the State of California (State) and participating local governmental agencies.
Local government agencies are defined as "any city, county, city and county, district or other local governmental body or corporation empowered to expend public funds for the acquisition of goods, information technology, or services", reference PCC section 10298 (a) (b) and PCC section 10299 (b). Local governmental agencies shall have the same rights and privileges as the State under the terms of these contracts.
WWT is not the manufacturer of the Original Equipment Manufacturer ("OEM") products or the provider of any OEM support or OEM professional services. WWT will pass through any warranty extended to WWT by the OEM. WWT further warrants that the deliverables provided by WWT professional services will be of the kind and quality designated in an applicable Statement of Work and that the WWT professional services will be performed in a professional and workmanlike manner. EXCEPT AS SET FORTH HEREIN OR IN AN APPLICABLE SOW, THE FOREGOING ARE THE SOLE AND EXCLUSIVE WARRANTIES GIVEN BY WWT AND ARE IN LIEU OF AND EXCLUDE ALL OTHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WWT DOES NOT WARRANT THE RESULT OF ANY PROFESSIONAL SERVICE OR THAT THE PROFESSIONAL SERVICE WILL MEET CUSTOMER'S REQUIREMENTS OR THAT ANY DELIVERABLE BE ERROR-FREE.
